By accessing or using our website and services (the "Services"), you agree to comply with and be bound by the following terms and conditions ("Terms"). 2. Eligibility

To sell with Didi Atelier, you must create an account on our website. You agree to provide accurate, current, and complete information and to keep your account details up-to-date. You are responsible for maintaining the confidentiality of your account and for all activities under your account.
4. Selling Process
Sign Up and Send Items
To sell items through Didi Atelier, you must sign up for an account. Once registered, you can send your South Asian wear to us using the pre-paid shipping label we provide.
Item Acceptance
All items submitted to Didi Atelier for consignment are subject to review. We reserve the right to accept or reject items based on quality, condition, and our inventory needs.
Photographs and Descriptions
After receiving your items, our team will photograph and describe them for listing. We will use our discretion to present the items in the best possible light.
Pricing and Sales
Pricing will be determined by Didi Atelier based on the condition, brand, demand, and other factors. We aim to ensure fair market value for both sellers and buyers. Once sold, proceeds from the sale will be issued to you as per your selected payment method.
5. Shipping and Handling
Shipping to Us
We will provide you with a pre-paid shipping label for you to send items to Didi Atelier at no charge.
Handling and Care
Upon receiving your items, we will carefully inspect, photograph, and handle them as we prepare them for listing. We reserve the right to decline items that do not meet our standards.
6. Payments
Once your items sell, you will be paid either via direct deposit or site credit, depending on your selection. Payments are processed as follows:
Direct Deposit
Payments will be made to your designated account after the sale is completed, minus our agreed-upon commission.
Site Credit
If you choose to receive site credit, it will be issued as a digital gift card for use on our website. Didi Atelier retains the right to charge fees and commissions on all sales, which will be disclosed to you upon account registration or prior to the sale of your items.
7. Commission and Fees
Didi Atelier charges a commission on the sale of your items, which varies depending on the item and its sale price. Details of these fees will be provided during the account sign-up process. We reserve the right to change our commission rates at any time.
8. Item Condition and Authenticity
Condition
You are responsible for ensuring the items you send to Didi Atelier are in excellent condition, free of defects, and meet our quality standards.
Authenticity
All items submitted must be authentic. By submitting your items, you confirm they are genuine and not counterfeit. Didi Atelier reserves the right to decline any items suspected to be counterfeit.
9. Customer Service and Returns
We pride ourselves on providing top-tier customer service. Any customer service inquiries related to your consigned items will be handled by our team.
Returns
We accept returns in accordance with our return policy, which is available on our website. Returns are generally allowed within a specific window (e.g., 7 days of receipt) for items that are unworn and in their original condition.
10. Ownership and Intellectual Property
Intellectual Property
All content on our website, including logos, images, text, and designs, is the property of Didi Atelier and is protected by copyright and intellectual property laws.
Ownership of Items
Once items are consigned to Didi Atelier, you retain ownership until the item is sold. Once sold, ownership is transferred to the buyer.
11. Limitation of Liability
Didi Atelier is not responsible for any loss, damage, or delay in shipping, or for any issues related to the item’s authenticity or condition post-sale. Our liability is limited to the extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Didi Atelier, its officers, directors, employees, and affiliates from any claims, damages, or liabilities arising from your breach of these Terms, your sale of items, or any other use of our Services.
13. Termination
We reserve the right to terminate or suspend your account at any time, without notice, for violations of these Terms or any behavior deemed inappropriate by Didi Atelier.
14. Governing Law
These Terms and Conditions are governed by the laws of New York, USA. Any disputes shall be resolved in the appropriate courts of law.
15. Changes to Terms

17. Off-Site Transactions Disclaimer
Didi Atelier strictly prohibits conducting transactions outside our platform. Any attempt to exchange contact details, payment information, or engage in sales or purchases off-site will result in immediate suspension of your account. We are not responsible for any issues, disputes, or transactions that occur off-site.
If any off-site transactions occur, they are at your own risk, and may result in permanent removal from the platform. All users are encouraged to report any off-site transaction attempts to ensure the safety and integrity of the platform.
18. Prohibited Conduct
By using our Services, you agree not to engage in the following:
- Violation of laws: You will not violate any applicable law, contract, intellectual property right, or other third-party right.
- Harassment and misconduct: You will not engage in any harassing, threatening, intimidating, or predatory conduct.
- Impersonation: You will not impersonate or post on behalf of any person or entity or misrepresent your affiliation with any person or entity.
- Unauthorized account use: You will not attempt to use another user's account without permission from that user or Didi Atelier.
- Commercial exploitation: You will not sell, resell, or commercially use our Services except as expressly permitted by Didi Atelier.
- Copying and reproduction: You will not copy, reproduce, or publicly display any portion of our Services without authorization.
- Modification and reverse engineering: You will not modify or reverse-engineer any part of our Services or try to bypass any security measures.
- Data scraping: You will not use any data mining, robots, or similar data gathering tools designed to scrape or extract data from our Services.
- Spam and unsolicited communications: You will not send unsolicited bulk communications or engage in chain letters, pyramid schemes, or any form of spam.
19. Unauthorized Use of Content
You may not copy, reproduce, or distribute any content, including but not limited to images, photographs, descriptions, or designs from the Didi Atelier website for commercial purposes without prior written permission from Didi Atelier. This includes using our photos, product listings, or content to promote items outside of Didi Atelier’s platform. Unauthorized use will result in account termination and may lead to legal action.
20. Arbitrator's Decision
The arbitrator has the sole authority to address all claims or arguments by both parties concerning the formation, legality, and enforceability of this arbitration clause, the scope of this clause, and the arbitrability of any claim or issue arising between you and Didi Atelier. Provided the parties have not agreed otherwise, the arbitrator will have the same powers as a court of competent jurisdiction to administer the arbitration and will administer the arbitration according to these Terms. The arbitrator will render an award within the timeframe specified in the NAM Rules.
The arbitrator's decision will include the essential findings and conclusions upon which the arbitrator based the award. The arbitrator's award shall be final and binding only between you and Didi Atelier and shall have no preclusive effect in any other arbitration or proceeding involving a different party. However, the arbitrator may consider rulings in other arbitrations involving different parties.
